(EN) Hyde Park is deeply concerned following the abusive, unjustified and illegal arrest of the human rights activist, artist and vice-president of the Hyde Park NGO – Anatol Matasaru.
On Friday, 29th of January 2016, at midday, the human rights activist, Anatol Matasaru was violently detained by twelve policemen dressed in civilian who showed up at Matasaru’s home without a prosecutor’s order of arrest or any other legal motivation. Given these highly suspicious and abusive methods of detention, we regard Matasaru’s arrest as illegal and a serious infringement of the universal human rights with serious consequences for the overall human rights situation in Moldova.
The police authorities have blatantly ignored the media when they inquired about the authorities’ motivations for the arrest. However, the detention comes straight after Anatol Matasaru organised a solitary protest on the 28th of January at the National Center against Corruption in Moldova. As an NGO with more than a decade of experience in the field of human rights and liberty of expression, we regard Matasaru’s protest from 28th of January as perfectly legal – it was a creative form of expression aligning with the national and international norms which protect a citizen’s right to express himself/herself.
Moreover, even if the police authorities have concluded that the activist’s protest at the National Center against Corruption was breaching the national law, the civilian dressed policemen who unexpectedly showed up at Matasaru’s house completely ignored all the legal norms and proceedings.
Given these abusive methods employed by the Moldovan police force, we highly urge national and international organisations, diplomatic bodies to closely monitor, take an active stance on the case and demand that Anatol Matasaru’s trial case be transparent, legal and in accordance with the national and international law norms. Your attention is highly critical in this case since Moldova has been known for its pattern of harassment and persecution of civic and human rights activists.
(RO) Declarație Hyde Park despre reținerea lui Anatol Mătăsaru
Hyde Park își anunță indignarea în legătură cu reținerea abuzivă și nejustificată a lui Anatol Mătăsaru, artist-activist, vicepreședinte ACI Hyde Park.
Pe 29 ianuarie la amiază, colegul nostru a fost ridicat din fața blocului în care locuiește exact în momentul cînd pornea la protestul anunțat din timp de către Hyde Park în fața Procuraturii Generale. Persoanele civile care l-au privat de libertate n-au avut niciun temei legal să-l rețină.
Considerăm că protestul solitar de ieri, din fața Centrului Național Anticorupție a fost perfect legal, o formă de exprimare artistică, civică a atitudinii critice față de sistemul de drept corupt, politizat. Anatol a făcut uz de drepturi fundamentale apărate de Constituție și de CEDO, libertatea de exprimare și dreptul la întrunire pașnică.
Dacă s-a deschis o cauză penală în legătură cu acel protest, persoana trebuia să fie citată legal cu asigurarea tuturor drepturilor procesuale, nu să fie răpită din stradă cum s-a întîmplat cu Anatol Mătăsaru.
Solicităm eliberarea urgentă și necondiționată a colegului nostru, prezentarea scuzelor publice din partea organelor de anchetă și pedepsirea conform legii a celor care i-au împiedicat activistului participarea la protest, faptă prevăzută de Codul Penal al RM la art 184.
